DNC understand that environmental aspect, particularly in relation to the global issue of climate change, has to be taken into account in our Clients’ business. We also realize that although the primary rules governing Climate Change & Emission Trading and Investment are set out internationally, the set of rules will need to be implemented within the host country (e.g. Indonesia) domestic legal system.
DNC fully comprehend that the policy and regulatory framework of Indonesia is a complex interaction of a structured hierarchy mechanism. In this blossoming field, many confusion, conflicts and overlapping conditions between the government regulations and local regulations are inevitable. Based on this, DNC have continually equipped its lawyers with the necessary understanding of the regulatory frameworks on the issues, not only nationally but also on the local/regional level. Supported by our years of expertise on investment and its strategies, DNC also strive to assist its Client to pin-point available new business opportunities and mitigation strategies, taking into account different emission trading schemes and emissions reduction projects (including CDM, JI and other structured carbon products).
DNC have been engaged in various transactions on the field. Our scope of works include but are not limited to reviewing and representing client on preparation and negotiation of Emissions Reduction Purchase Agreement(ERPA) as well as issuing legal opinion and advices from Indonesian law perspective for the transaction. DNC have also been chosen as the legal counsel to assist the Indonesian government with its Clean Technology and Low Carbon Investment Program in 2009, working particularly with Pusat Investasi Pemerintah. DNC have also continuously arrange meetings and discussions on the topics, both internally and with relevant stakeholders, including several pioneer private consultants, project developer companies as well as the UNFCCC in order to understand the technical and business aspects of the issues and to maintain updated database on the current trends.
