


DNC’s deep knowledge of the legal and taxation aspects of production sharing contracts (‘PSC’) and technical assistance contracts (‘TAC’) has resulted in it representing Indonesian clients in an oil concession project in Vietnam and secondary oil recovery projects in Indonesia, and working for the United States tax authority in reviewing and determining the (tax) nature of amounts payable to the Government of Republic of Indonesia and/or Pertamina (Indonesia’s state oil company). It also resulted in work on the restructuring of various interests in PSCs and TACs held by the owner of Kondur Petroleum S.A. DNC has been consulted by the Regional Government of Bojonegoro to structure their participating interest in Cepu block together with the other provincial and regional governments in Middle and East Java.
In the mining sector, DNC’s familiarity with the applicable regulations, the contracts (Contracts of Work and also Coal Cooperation Agreement) and the industry has proven to be very valuable for its clients in dealing with the government and/or their business counterparts. It has also resulted in DNC’s involvement in the Bre-X (Busang gold mine) case and PT Kaltim Prima Coal (KPC) and its shareholders failure to comply with their respective obligations under Article 26 (on Participation and Promotion of National Interest) of KPC’s Coal Cooperation Agreement.
